Warranty

1. The warranty provided for a new agricultural sprayer manufactured by “Degania Industries Ltd.” is for one year after its supply. The date is the one noted on the shipping manifesto signed by the recipient.
2. The warranty applies to the assemblies and components manufactured by “Degania Industries Ltd.”.
3. The warranty to assemblies and components not manufactured by Degania Industries Ltd.” (hereinafter: the Parts) lies on the parts manufacturer through its agent in Israel. The parts manufacturers or any on their behalf decide on such a warranty. “Degania Industries Ltd.” will assist the client to the best of its ability.
4. The warranty does not apply to parts which reasonable wear and tear is less than a year, such as: rubber parts, electric accessories, oil returners, filters, sprinklers, fuses, and other components the warranty does not apply to.
5. The warranty only applies in the event of operation per the manufacturer’s instructions. In the event of damage caused by operation contrary to the manufacturer’s instructions, the full repair cost (including travel) shall be paid by the client, per the “Degania Industries Ltd.” rates.
6. Repairing damages caused by malicious action, accident, or uncareful use shall be paid for by the client and shall not be covered by this warranty.
7. As part of this warranty, “Degania Industries Ltd.” shall only bear the cost of repairing the sprayer.
8. The warranty of “Degania Industries Ltd.” does not apply to resultant or third-party damage, other than in cases covered by the product’s manufacturer’s insurance.
9. In case of a malfunction, the sprayer’s owner shall inform “Degania Industries Ltd.” immediately about it, and will not repair the sprayer by himself, or refer to another party, without prior consent.
10. In case of a service call without a reason, the client shall pay a full payment per the “Degania Industries Ltd.” rates. The warranty is provided to the client listed in the invoice. In the case of sale of the sprayer to a third party, the warranty shall only be valid with the prior written consent of “Degania Industries Ltd.”.

General Order Terms and Conditions

1. The prices above are in NIS and do not include VAT.
2. The reception of credit from “Degania Industries Ltd.” requires providing guarantees to the company’s satisfaction and full payment of the VAT.
3. Cancellation of the order by the client entails a charge of 12% of the order’s value.
4. The goods shall remain under the ownership of “Degania Industries Ltd.” until the payment of all cheques.
5. The warranty shall be provided in the plant’s area and subject to the terms and conditions. Transporting a machine to the plant shall be at the client’s expense.
6. The City of Nazareth was decided by agreement of all parties as having jurisdiction over all this order’s needs, but nothing here shall abrogate from the right of “Degania Industries Ltd.” to sue the client in any other court of law.
7. The final price shall be determined upon the machine’s delivery.
8. The price shall be subject to review and approval by the Company’s credit committee.
9. The order is conditional on the management’s approval.
10. The supply time is an estimate, in workdays, not including Fridays, Saturdays, holiday eves, and holidays, and is from the day the order was approved or fully paid for – the latest among these.
11. A delay of up to fourteen workdays shall not be considered a delay.
12. The client’s or his representative’s signature on this order constitutes an approval of the order and the client undertakes that he has fully reviewed the terms and conditions and agrees to them.
